The FDA recently issued a cease-manufacture order to a California man who donates sperm to local couples, calling him a "manufacturer of human cells" and claiming that he must comply with FDA regulations applicable to sperm banks or fertility clinics or risk prosecution. But when private individuals want to conceive a child, without medical assistance or money changing hands, can the government legitimately intervene?
