This seminar will explore what the Supreme Court has called "perhaps our oldest question of constitutional law": the division of authority between the states and the national government. The focus will be on contemporary American federalism, but topics will range broadly and include normative theories of federalism; the evolution of federalism in the United States; the role of various institutions in safeguarding federalism; constitutional doctrines of federalism; and the relationship between federalism and political identity.
