Indian constitutional law and politics has adopted key concepts in contemporary political theory like democracy and equality, which emerged and were refined in European and North American historical settings, in novel and unanticipated ways. In this course we examine the ways in which Indian constitutional law and doctrine has dealt with constitutionalism and democracy; separation of powers; rights based limits to democracy; republicanism, equality and social justice; federalism and subsidiarity; nationalization and liberalization of the economy; secularism and the relationship of the state with religious groups. We read primary legal materials, including the Constitution of India 1950 and selected cases, as well as major works on Indian political history and theory.
Each student will write a 15 page seminar paper and complete a take home exam.
