Attendance at the first class on Tuesday, Sept. 2, is mandatory for all registered students and for wait-listed students who wish to be considered for admission to the seminar. Students on the wait list will be admitted to the course only by permission of the instructor.
This course examines the fundamental legal and business building blocks for real estate transactions. It employs a transactional approach (with planning problems) and examines both commercial and residential real estate transactions in the context of relevant documentation. Students explore the real-world cycle of deciding whether to invest, selecting the ownership entity, resolving legal issues that arise at the contract stage, securing financing, and exploring legal issues that arise post-closing. Topics discussed include the role of the attorney in the transaction, broker participation and responsibilities, risks at the contract and remedies for breach, covenants of title and the security of title including recording act issues, real estate financing, and foreclosure risks and proceedings.
